KID-IA: An AI-based technology application (hereinafter “the App”) consisting of a mobile app that provides access to personalized activities for educational stimulation and comprehensive user development, focusing on each individual’s identified opportunity areas. It is aimed at both minors and adults, allowing tutors and professionals to plan, manage, and supervise these activities.

Mobile Application: Software specifically designed to run on portable devices such as smartphones and tablets.

User: Any individual or legal entity accessing the App, whether a tutor, minor, or professional.

Tutor: The legally responsible adult overseeing a minor registered in the App.

Personal Data: Any information relating to an identified or identifiable person, processed in accordance with the Federal Law on Protection of Personal Data Held by Private Parties.

Login and Password: The system enabling identification, authentication, and control of roles/permissions (administrator, professional, or user) accessing the web platform for service management and use, ensuring secure, reliable, and truthful access.

Purpose of the Agreement

This document governs access to, use of, and operation of the KID-IA App, as well as the relationships among users, tutors, and the platform developers.

KID-IA commits to providing dynamic, personalized educational activities through an AI-based system, promoting learning according to the detected opportunity areas.

Use of the App implies full acceptance of these conditions, which may be modified at any time.

Registration and Access Profiles

User Registration: Users must complete a form with accurate and up-to-date information.

Minors: Registration of minors must be carried out by an authorized tutor, who is responsible for proper use of the App and the security of the minor’s data.

Profiles:

Tutor: Responsible for managing the minor’s account.

Professional: May create and supervise personalized activities.

Minor: Accesses only the activities designated by the tutor or professional.

Suspension of Access: KID-IA reserves the right to suspend accounts for misuse, fraudulent activity, or breach of these terms.

Use of the Platform

Permitted Use: The App must be used exclusively for educational purposes and in compliance with applicable Mexican law.

Prohibitions:
- Reverse engineering of the software.
- Distribution of offensive or inappropriate content.
- Use of the platform for harassment or illegal activities.

Security Incidents: Users must report any unauthorized use or security incident to support@kid-ia.com.

Intellectual Property

All content and software used in the App are the exclusive property of KID-IA and are protected by intellectual property laws.

Reproduction, distribution, or modification without express authorization is prohibited.

Protection of Personal Data

Definition of Personal Data: According to the Federal Law on Protection of Personal Data Held by Private Parties, personal data refers to any information relating to an identified or identifiable natural person (e.g., names, surnames, photographs, email addresses). KID-IA collects this data to personalize educational activities according to detected opportunity areas.

Sensitive Personal Data: The platform may process sensitive data, such as health information or the minor’s educational performance, requiring an additional level of protection.

Consent and Purposes of Processing: Tutors must give express consent for processing the minor’s data. This processing is intended solely to personalize educational activities, track development, and conduct internal statistical studies in anonymized form.

ARCO Rights (Access, Rectification, Cancellation, and Opposition):

Access: Know which personal data are being processed.

Rectification: Request correction of incorrect or outdated data.

Cancellation: Request deletion of data when no longer necessary for the original purposes.

Opposition: Object to the use of data for specific purposes, provided this does not impede the provision of the contracted service.

Security Measures for Data Processing: KID-IA will implement appropriate technical and organizational measures (such as encryption of sensitive data, restricted access controls, and secure authentication systems) to protect personal data against unauthorized access, loss, or misuse.

Data Transfers and Third Parties: Personal data will not be shared with third parties without user consent, except as required by law. When using external service providers, they must comply with established protection standards.

Data Anonymization: Personal data that have been anonymized and no longer allow identifying the data subject may be used for statistical or internal improvement purposes without additional consent.

Retention Period: Personal data will be retained only for as long as necessary to fulfill the established purposes and will be securely deleted once no longer needed.

Tutor and User Responsibility: The tutor is responsible for ensuring proper use of the platform by the minor and for ensuring compliance with these terms regarding personal data.

KID-IA Responsibilities

Service Availability: KID-IA commits to maintaining platform availability, although it does not guarantee uninterrupted or error-free service.

Disclaimer: KID-IA will not be liable for indirect or consequential damages caused by the use of the App.

Modifications to the Service and Terms

Service Updates: KID-IA may modify features or terms of use at any time.

Notification of Changes: Changes will be communicated via the App or email and will be deemed accepted if the user continues to use the platform.

Termination of the Agreement

User Cancellation: The user may cancel their account at any time by contacting support.

Suspension for Breach: KID-IA may suspend or cancel accounts that breach the established terms.

Data Access After Cancellation: Access to data and activities will be revoked immediately upon account cancellation.
